この利用規約（以下「本規約」といいます）は、VB Holdings Co., Ltd.（以下「当社」といいます）が運営する英語教室「ベストアカデミー」、本ウェブサイト、および保護者向けアプリ（以下あわせて「本サービス」といいます）の利用条件を定めるものです。
第1条（適用）
本規約は、本サービスを利用するすべての方（生徒および保護者を含みます。以下「利用者」といいます）に適用されます。各教室が別途定めるルールがある場合は、そのルールも本規約の一部となります。
第2条（入会）
入会を希望する方は、当社所定の方法でお申し込みいただき、当社が承諾した時点で契約が成立します。
第3条（授業料など）
授業料などの金額およびお支払い方法については、各教室までお問い合わせください。
第4条（授業・休講・振替）
授業の日程、休講および振替については、各教室の定めによります。詳しくは各教室までお問い合わせください。
第5条（保護者向けアプリのアカウント）
- 利用者は、保護者向けアプリのログイン情報を自己の責任で管理し、第三者に利用させてはなりません。
- ログイン情報の管理が不十分であったために生じた損害について、当社に故意または過失がある場合を除き、当社は責任を負いません。
第6条（禁止事項）
利用者は、次の行為をしてはなりません。
- 法令または公序良俗に反する行為
- 他の生徒、保護者、講師、スタッフへの迷惑行為や誹謗中傷
- 授業や教室の運営を妨げる行為
- 授業の無断での録音・録画、教材の無断での複製・配布
- 本サービスのシステムへの不正なアクセス
- その他、当社が不適切と判断する行為
第7条（写真の掲載）
生徒が当社のウェブサイト等に掲載される写真に写るのは、保護者の同意を得た場合に限ります。写真の取扱いおよび同意の撤回については、プライバシーポリシーに定めます。
第8条（知的財産権）
本ウェブサイトおよび保護者向けアプリに掲載されている文章、画像、デザインなどの権利は、当社または正当な権利者に帰属します。授業で使用する市販の教材の権利は、各出版社などに帰属します。
第9条（免責）
- 当社は、本ウェブサイトに掲載する情報の正確さに努めますが、その内容は予告なく変更されることがあります。
- 天災、感染症の流行、通信障害など、当社の責めに帰すことのできない事由により本サービスを提供できない場合、当社は責任を負いません。
- 当社の故意または重大な過失による場合を除き、当社が負う損害賠償の範囲は、通常生ずべき直接の損害に限ります。
第10条（サービスの変更・停止）
当社は、事前に利用者へ通知したうえで、本サービスの内容を変更し、または提供を停止することがあります。緊急の場合は、事後の通知となることがあります。
第11条（退会）
退会の手続きおよび返金については、返金・キャンセルポリシーに定めます。
第12条（本規約の変更）
当社は、必要に応じて本規約を変更することがあります。変更する場合は、変更後の内容と効力発生日を本ウェブサイトなどで事前にお知らせします。
第13条（準拠法）
本規約は日本法に準拠します。
第14条（管轄裁判所）
本規約に関する紛争については、甲府地方裁判所を第一審の専属的合意管轄裁判所とします。

These terms of use (the "Terms") set out the conditions for using the Best Academy English schools, this website and the parent app (together, the "Services"), operated by VB Holdings Co., Ltd. ("we", "us").
1. Scope
These Terms apply to everyone who uses the Services, including students and guardians ("Users"). Any rules set by an individual school also form part of these Terms.
2. Enrolment
To enrol, apply using our designated method. The contract is formed when we accept the application.
3. Fees
For fees and payment methods, please contact your school.
4. Lessons, cancellations and make-up lessons
Lesson dates, cancellations and make-up lessons follow each school's rules. Please contact your school for details.
5. Parent app accounts
- Users must keep their parent app login details safe and must not let others use them.
- We are not liable for loss caused by poor management of login details, unless we are at fault.
6. Prohibited conduct
Users must not:
- Break the law or act against public order and morals
- Harass or defame other students, guardians, teachers or staff
- Disrupt lessons or the running of a school
- Record lessons or copy and distribute materials without permission
- Access our systems without authorisation
- Do anything else we reasonably consider inappropriate
7. Photos
Students appear in photos on our website and similar channels only with a guardian's consent. How we handle photos, and how to withdraw consent, is set out in our privacy policy.
8. Intellectual property
Text, images and design on this website and the parent app belong to us or their rightful owners. Published textbooks used in lessons belong to their publishers.
9. Disclaimer
- We aim to keep information on this website accurate, but it may change without notice.
- We are not liable when we cannot provide the Services for reasons beyond our control, such as natural disasters, epidemics or network outages.
- Except in cases of intent or gross negligence, our liability is limited to direct damage that would ordinarily arise.
10. Changes to the Services
We may change or stop the Services after notifying Users in advance, or afterwards in an emergency.
11. Withdrawal
Withdrawal and refunds are covered by our refund and cancellation policy.
12. Changes to these Terms
We may change these Terms. We will announce the new Terms and their effective date in advance on this website or by other means.
13. Governing law
These Terms are governed by Japanese law.
14. Court with jurisdiction
The Kofu District Court has exclusive jurisdiction as the court of first instance for any dispute relating to these terms.
